Service Agreement

A.The client understands that a non-refundable deposit of $50 is required to reserve Photographer’s services for the agreed-upon date and time unless otherwise stated by My Photo Album. This deposit fee goes towards the remaining balance of the session.

A.The Client shall pay in full the balance of the package and any additional services incurred by the day the photography services are rendered at the end of the photography session. Payment must be made using CASH, or ELECTRONIC PAYMENT. Should the client be late in making payment for more than 14 days- the images will be permanently deleted from the photographer's hard drive & the deposit will be forfeited.

A.The family portrait doesn't include extended family members. $25 per person will be charged should they be included in the shoot. It is the client's responsibility to advise My Photo Album prior to the session.

A.The deposit is non-refundable. Due to the nature of the photography service, My Photo Album is unable to provide a refund once the shooting is completed. In the unlikely event should the client requested a refund after the shooting, $100 per hour labour fee will be deducted from your booked package, the rest will be refunded to the client nominated account. All the digital images will be permanently deleted.

A.It is the client responsibility to inform the photographer to reschedule 24 hours prior to the session otherwise the forfeiture of the deposit fee will occur. My Photo Album will make every effort to reschedule as long as there are no other sessions scheduled. You may only reschedule once.

A.The deposit is non-refundable. Should the client wish to cancel the shoot after the session commenced, $50 per 30mins labour fee will be charged.

A.My Photo Album will wait approximately 20 minutes before determining the session as a no-show. 50% of the booked package cost will be invoiced to the client if no show. Coming late to your session will result in less time allotted for your session and resulting in less images & setups/poses available.

A.Re-shoots are determined at the discretion of My Photo Album. Re-shoots will not be given for poor choices of clothing, make-up, hair or weather-related issues, non-cooperation from any of the parties involved, or by not following the recommendations of the photographer.

A.All sessions are led by the baby and children. The client can express what poses they want however the results may vary due to the cooperation & limitations of the baby & children. It is the client's responsibility to disclose any medication conditions that may help with the posing.

A.My Photo Album does not deliver raw images. My Photo Album is not liable to deliver every image taken at the Photography session. The determination of images delivered to the client is left to the discretion of My Photo Album.

A.The client understands that under normal circumstances images will be available within 2-3 weeks after the date of the photography session. The client has 2 weeks to select their final images from the gallery otherwise the gallery will be expired. A reactivate fee of $20 may occur or as otherwise agreed by My Photo Album.

A.If the client has a request for an alteration of an image, a fee of $30/image may be charged. The final post-production editing styles, effects, and overall look of the images are left to the discretion of My Photo Album.

A.The client must obtain written permission from My Photo Album and compensate My Photo Album prior to the client or their friends and family publishing or selling the photographs for profit.

A.The Photographer shall own the copyright on all images created and shall have the exclusive rights to make reproductions. The client has the right to make reproduction for non-commercial purposes. The Photographer shall make reproductions for the Photographer’s portfolio, samples, entry in photographic contests or art exhibitions, or for display within or outside of the Photographer’s studio.

A.The client hereby assigns My Photo Album the irrevocable and unrestricted right to use and publish photographs of the client or in which the client may be included, for editorial, trade, advertising, educational, and any other purpose and in any manner and medium; to alter the same without restriction and to copyright the same without restriction. The client releases all claims to profits that may arise from the use of images. My Photo Album will respect the client's wishes not to share the images on social media platforms. If the client doesn't agree for My Photo Album to use the images on social media, written notification is required before shooting day.

A.In the unlikely event that the photographer from My Photo Album is unable to perform to the guidelines of this contract due to an injury, illness, act of God, act of terrorism, or other cause beyond the control of My Photo Album then My Photo Album will make every effort to secure a replacement, extra cost may apply. In the unlikely event that digital files have been lost, stolen, or destroyed for reasons beyond My Photo Album's control, including but not limited to camera, hard drive, or equipment malfunction, My Photo Album's liability is limited to the return of all payments received for the photography session.
